1. About The Counselling Network
The Counselling Network, also referred to as “TCN”, “we”, “us” or “our”, is a UK-based counselling directory and professional membership platform.
TCN aims to support counsellors, psychotherapists and related professionals by providing access to:
– A professional directory profile
– Client enquiry and booking functionality
– Payment support
– CPD access and discounts
– Clinical resources
– Networking opportunities
– Professional community support
– Future digital tools, including TherapAI, where available
TCN also allows clients, members of the public and organisations to search for counsellors and related professionals.
TCN is not an emergency, crisis or urgent mental health service.
If you or someone else is at immediate risk of harm, call 999 or attend your nearest Accident and Emergency department. If you need urgent mental health support, contact NHS 111, your GP, your local crisis team, Samaritans on 116 123, or another appropriate crisis service in your area.
—
2. Definitions
In these Terms:
“Client” means a person who uses TCN to search for, contact, enquire about, book or pay for counselling or related support.
“Counsellor” means a professional listed on TCN, including counsellors, psychotherapists, supervisors, children and young people’s counsellors, couples counsellors and other approved professionals.
“Member” means a counsellor or professional who has registered for a TCN membership package.
“Platform” means the TCN website, booking system, payment system, member area, resource library, CPD area, AI tools and any related digital service.
“Services” means all services provided through TCN, including membership, directory listings, access to resources, CPD, bookings, payments, community features and digital tools.
“TherapAI” means any AI-supported reflective or clinical-support feature introduced by TCN, designed to assist counsellors with ethical reflection, formulation, intervention ideas and professional thinking using non-identifiable information only.
“User” means anyone who accesses or uses the website or platform, including clients, counsellors, members, visitors and organisations.
—
3. What TCN does and does not provide
TCN provides a platform that helps connect clients with counsellors and supports counsellors with professional tools, visibility and resources.
Unless expressly stated otherwise, TCN does not directly provide counselling, psychotherapy, diagnosis, medical treatment or emergency support.
Counsellors listed on TCN are independent professionals. They are responsible for their own clinical practice, professional judgement, client work, insurance, registration, supervision, record keeping, safeguarding duties, GDPR compliance and ethical obligations.
TCN may carry out checks on counsellor members, but a listing on TCN does not guarantee that a counsellor is suitable for every client or every presenting issue.
Clients are responsible for deciding whether a counsellor feels appropriate for them. Counsellors are responsible for deciding whether they are competent and ethically able to work with a client.
—
4. Eligibility to use TCN
You may use the public areas of the website if you comply with these Terms.
To create an account, book a session, register as a counsellor, access resources or purchase membership, you must provide accurate information and have legal authority to enter into these Terms.
If you are under 18, your use of TCN must involve appropriate consent, support or involvement from a parent, carer, guardian or responsible adult, unless the counsellor has assessed that you can lawfully consent to support in your own right.
TCN may refuse, suspend or cancel access where we believe a user:
– Has provided false or misleading information
– Is misusing the platform
– Is acting in a way that places others at risk
– Is attempting to avoid agreed fees
– Is breaching these Terms
– Is acting unlawfully, abusively or unethically
– Is unsuitable for the platform
—
5. Counsellor membership
TCN offers membership packages for counsellors and approved professionals. These may include, depending on the package purchased:
– A directory profile
– Client enquiry tools
– Booking system access
– Calendar integration
– Payment system access
– Session package tools
– Cancellation policy settings
– CPD discounts or CPD access
– Clinical resource library access
– Networking opportunities
– Community features
– TherapAI access, where available
– Additional professional support features
The exact features, limits and pricing for each membership tier will be shown on the website or agreed separately.
TCN may offer different membership levels, including but not limited to Silver, Gold and Platinum. TCN may also offer founding member rates, promotional rates, organisational rates or limited-time offers.
Membership benefits are not transferable unless TCN agrees in writing.
—
6. Counsellor registration requirements
Counsellors applying to join TCN must provide accurate and up-to-date information, which may include:
– Full legal name
– Professional name
– Contact details
– Practice type
– Qualifications
– Professional body membership
– Registration number
– Insurance details
– Supervision arrangements
– Areas of practice
– Client groups
– Experience
– Disclosure information where relevant
– Location and online availability
– Confirmation of ethical practice
TCN may ask for evidence of qualifications, insurance, professional membership, identity, supervision or other relevant information.
Counsellors must tell TCN promptly if any important information changes, including changes to insurance, professional registration, disciplinary status, suitability to practise, supervision, safeguarding restrictions or legal status.
TCN may reject or remove a counsellor application or profile if we believe the counsellor is unsuitable, unsafe, misleading, unethical or does not meet the standards expected by the platform.
—
7. Counsellor responsibilities
Counsellors using TCN are responsible for:
– Practising within their competence
– Following their professional body’s ethical framework
– Maintaining suitable professional indemnity insurance
– Maintaining appropriate supervision
– Keeping accurate client records
– Managing safeguarding duties
– Managing risk and crisis situations
– Complying with data protection law
– Setting and following clear boundaries
– Charging clients appropriately and transparently
– Keeping their profile accurate
– Responding to enquiries professionally
– Honouring bookings wherever reasonably possible
– Managing cancellations and refunds fairly
– Not making misleading claims about outcomes, qualifications or experience
Counsellors must not use TCN to claim that they can guarantee recovery, cure, diagnosis, treatment outcomes or specific clinical results.
Counsellors must not upload or share client-identifiable information within any TCN resource, community space or TherapAI feature unless TCN has expressly confirmed that the relevant system is appropriate for that purpose.
—
8. Directory profiles
Counsellors are responsible for the content of their directory profile.
Profile information must be accurate, professional, lawful and not misleading.
TCN may edit, refuse, suspend or remove profile content if we believe it is:
– Inaccurate
– Misleading
– Unethical
– Discriminatory
– Offensive
– Clinically unsafe
– In breach of advertising rules
– In breach of these Terms
– Harmful to TCN’s reputation
TCN may give guidance on improving profiles but does not guarantee that any profile will generate enquiries, bookings, referrals or income.
—
9. Client use of the directory
Clients may use TCN to search for counsellors and related professionals.
TCN does not guarantee that:
– A counsellor will be available
– A counsellor will accept a booking
– A counsellor will be clinically suitable
– Counselling will produce a particular outcome
– A client will be accepted for ongoing work
– A specific presenting issue can be supported through the platform
Clients should read counsellor profiles carefully and ask questions before beginning work.
If a client is unsure whether counselling is appropriate, they should speak with their GP, NHS service, crisis service or another qualified professional.
—
10. Bookings
TCN may provide an integrated booking system allowing clients to book sessions with counsellors.
Bookings are subject to counsellor availability, suitability and acceptance.
A booking may be cancelled, amended or declined where:
– The counsellor is unavailable
– The counsellor believes the work is outside their competence
– The client’s needs require a different service
– There is a safeguarding or risk concern
– Payment has not been completed
– The booking appears fraudulent, abusive or inappropriate
– There is another reasonable professional or operational reason
Counsellors must keep their availability accurate and must communicate clearly with clients about session format, location, duration, fees and cancellation terms.
Where a client books through the TCN booking system, the counsellor agrees that the booking and associated payment should be managed through the TCN platform unless TCN has agreed otherwise in writing.
TCN is not responsible for a counsellor’s clinical decision to accept, decline, pause, end or refer on a client.
—
11. Payments
TCN may provide an integrated payment system for client payments, counsellor membership payments, CPD purchases or other services.
Payments may be processed by a third-party payment provider such as Stripe or another provider. By making or receiving payments through TCN, you agree to comply with the payment provider’s terms where applicable.
Where a client books and pays for counselling or related professional services through the TCN booking and payment system, TCN will retain 10% of the session fee as a platform administration and systems management fee.
This 10% retained fee contributes towards:
– Payment system management
– Stripe administration and payment processing support
– Booking system administration
– IT support and platform maintenance
– Systems management
– Client and counsellor administration linked to the booking process
– Ongoing development and support of the TCN platform
The remaining balance will be paid to the counsellor, subject to any applicable payment processing deductions, refunds, chargebacks, failed payments, taxes or other agreed fees.
Counsellors using the TCN booking and payment system agree that this 10% platform fee may be automatically deducted before payment is transferred to them.
TCN may charge:
– Membership fees
– Platform fees
– Booking fees
– Transaction fees
– Commission or service fees
– CPD fees
– Resource fees
– Administrative fees
– Other charges shown at the point of purchase
All fees will be displayed before payment wherever required.
Counsellors are responsible for their own tax, accounting, invoices, income reporting and financial obligations unless TCN expressly agrees otherwise.
TCN is not responsible for bank charges, card charges, currency conversion fees or third-party payment processing issues outside our reasonable control.
—
12. Membership fees and renewals
Membership fees may be charged monthly, annually or on another agreed basis.
By purchasing a recurring membership, you authorise TCN or its payment provider to take recurring payments until the membership is cancelled.
You are responsible for ensuring your payment method remains valid.
If payment fails, TCN may:
– Contact you for updated payment details
– Restrict access to membership features
– Suspend your profile
– Remove directory visibility
– Cancel your membership
– Recover unpaid fees where lawful and reasonable
TCN may change membership prices. Where required, we will give notice before price changes affect existing recurring members.
Promotional, founding member or discounted rates may have separate conditions. If a member cancels or fails to maintain payment, they may lose access to that rate.
—
13. Cancellations and refunds for memberships
You may cancel your membership according to the cancellation process shown on the website or by contacting TCN at info@thecounsellingnetwork.co.uk.
Cancellation will usually stop future payments but will not automatically refund payments already made, unless required by law or agreed by TCN.
If you are a consumer purchasing online, you may have a 14-day cancellation right unless an exemption applies, for example where digital content or services have been accessed or started with your consent during the cancellation period.
Where you request immediate access to digital content, CPD, resources, member benefits or platform services, you may lose some or all of your cancellation rights once access has started.
TCN will explain relevant cancellation rights at the point of purchase where required.
Refunds are assessed fairly and in line with consumer law, the nature of the product, access already given, and any specific refund terms shown at purchase.
—
14. Client session cancellations and refunds
Cancellation terms for counselling sessions may vary depending on the counsellor.
Counsellors must clearly state their cancellation policy before or at the point of booking.
A counsellor may charge for late cancellations, missed sessions or non-attendance where this has been made clear to the client.
Where payment has been made through TCN, refunds may be processed through the TCN payment system. Any refund may be subject to payment provider rules, processing times, chargeback rules and any fees that cannot be recovered from third-party payment providers.
TCN may support payment and refund administration, but the counsellor remains responsible for setting fair, ethical and lawful cancellation terms for their own clinical work.
Where there is a dispute about a cancelled or missed session, TCN may review available booking and payment information, but TCN is not required to make clinical decisions or take responsibility for matters outside the platform’s control.
—
15. CPD, training and resources
TCN may provide CPD, training materials, worksheets, psychoeducation tools, clinical resources, templates, reflection tools and signposting resources.
These materials are provided for professional learning, information and support only.
They are not a substitute for:
– Professional training
– Clinical supervision
– Personal therapy
– Medical advice
– Legal advice
– Safeguarding advice
– Emergency support
– A counsellor’s own professional judgement
Counsellors are responsible for deciding whether a resource is appropriate for a particular client, presenting issue, age group, risk level, modality or stage of therapy.
TCN does not guarantee that CPD or resources will meet the requirements of every professional body, employer, regulator, insurance provider or training organisation.
Where CPD certificates are issued, they confirm attendance or completion only. They do not confirm competence unless expressly stated.
—
16. Resource library use
Resources provided by TCN may be used by active members in their own professional practice, subject to the licence terms below.
Unless otherwise stated, members may:
– Download resources for their own professional use
– Use worksheets with their own clients
– Print resources for direct client work
– Store resources securely within their own practice systems
– Refer to resources in supervision or reflective practice
Members must not:
– Resell TCN resources
– Upload TCN resources to another website
– Share resources publicly
– Remove TCN branding or copyright notices
– Claim resources as their own
– Use resources to create a competing product
– Distribute resources to non-members as a resource pack
– Use resources in a way that is clinically unsafe, unlawful or unethical
Access to resources may end when membership ends.
—
17. TherapAI and AI-supported tools
TCN may introduce TherapAI or other AI-supported tools.
TherapAI is intended to support counsellors with reflection, formulation, ethical thinking, intervention ideas, CPD reflection and professional development.
TherapAI is not:
– A therapist
– A supervisor
– A safeguarding lead
– A crisis service
– A diagnostic tool
– A replacement for clinical judgement
– A replacement for professional training
– A replacement for supervision
– A replacement for legal, medical or regulatory advice
Counsellors must not enter client-identifiable information into TherapAI unless TCN has expressly confirmed in writing that a specific tool is designed and approved for that purpose.
Counsellors using TherapAI must anonymise or sufficiently de-identify any information entered.
AI outputs may be incomplete, inaccurate, unsuitable or inappropriate. Counsellors remain fully responsible for checking, interpreting and deciding whether to use any AI-generated suggestion.
TCN may monitor, improve, restrict or withdraw AI tools at any time.
Additional TherapAI terms may apply when the service is launched.
—
18. Safeguarding and risk
TCN takes safeguarding seriously, but it is not an emergency service and does not provide crisis response.
Counsellors are responsible for managing safeguarding and risk within their own practice, including:
– Suicide risk
– Self-harm risk
– Harm to others
– Child protection concerns
– Adult protection concerns
– Domestic abuse concerns
– Capacity concerns
– Information sharing
– Record keeping
– Escalation to appropriate services
Counsellors must follow applicable law, professional guidance, local safeguarding procedures and their own professional body requirements.
Clients must not use TCN as a crisis service. If there is immediate risk, clients should contact emergency services or urgent support services.
TCN may take action if we become aware of serious safeguarding concerns, including contacting emergency services, suspending accounts, removing profiles or sharing information where lawful and necessary.
—
19. No guarantee of referrals or income
TCN aims to increase counsellor visibility and reduce professional isolation, but membership does not guarantee:
– Client enquiries
– Bookings
– Referrals
– Income
– Search ranking
– Profile views
– Business growth
– Full caseloads
– Any specific commercial outcome
TCN may offer guidance, resources and tools to help members improve their profile and professional visibility, but counsellors remain responsible for their own practice development, availability, pricing, responsiveness and suitability.
—
20. Platform ranking, visibility and search results
TCN may use search, filters, categories, profile quality indicators, location, availability, membership level, client preferences, specialisms or other factors to display counsellor profiles.
TCN does not guarantee equal visibility for all profiles.
TCN may promote certain profiles, groups, founding members, specialist categories, paid features or availability-based listings where this is made clear and does not mislead users.
TCN may update search and ranking systems at any time.
—
21. Reviews, testimonials and feedback
TCN may allow clients, members or organisations to provide reviews, testimonials or feedback.
Reviews must be honest, lawful and based on genuine experience.
Users must not submit reviews that are:
– False
– Misleading
– Abusive
– Discriminatory
– Defamatory
– Clinically inappropriate
– Breaching confidentiality
– Written in exchange for improper reward
– Written by someone with a conflict of interest
TCN may edit, refuse, remove or moderate reviews where necessary.
Counsellors must not pressure clients to leave reviews in a way that compromises the therapeutic relationship, confidentiality, consent or ethical practice.
TCN may use testimonials for marketing where permission has been given.
—
22. Community, networking and member conduct
TCN may provide community spaces, networking events, discussion forums, peer support spaces, supervision links or professional groups.
Users must engage respectfully and professionally.
Users must not:
– Share identifiable client information
– Give unsafe clinical advice
– Harass, bully or intimidate others
– Discriminate against others
– Promote hate, abuse or exploitation
– Spam members
– Misuse contact details
– Promote unrelated services without permission
– Breach confidentiality
– Act in a way that damages TCN or the community
TCN may moderate, remove content, suspend accounts or remove members who breach these standards.
Community spaces are not a substitute for clinical supervision, legal advice, safeguarding advice or formal professional consultation.
—
23. Prohibited use
You must not use TCN to:
– Break the law
– Commit fraud
– Mislead clients or professionals
– Impersonate another person
– Upload harmful code or malware
– Scrape, copy or harvest data
– Interfere with the platform’s operation
– Access accounts without permission
– Misuse payment systems
– Avoid agreed fees
– Send spam or unsolicited marketing
– Harass or abuse others
– Post discriminatory or offensive material
– Share confidential information unlawfully
– Offer services you are not qualified or insured to provide
– Damage the reputation, safety or operation of TCN
TCN may restrict, suspend or terminate access where prohibited use is suspected.
—
24. Contacting clients outside TCN
Where a client first contacts, books or pays a counsellor through TCN, the counsellor must not misuse the platform to avoid agreed TCN fees, booking terms or payment processes.
Counsellors must not deliberately divert TCN-generated bookings, enquiries or repeat sessions away from the TCN booking and payment system for the purpose of avoiding the agreed 10% platform administration and systems management fee.
Counsellors may continue therapeutic work with clients in line with ethical practice, but they must not use TCN to generate client contact and then bypass the platform payment process unless TCN has agreed this in writing.
This clause does not prevent counsellors from acting in a client’s best interests, making appropriate referrals, ending work ethically, or arranging alternative care where clinically necessary.
—
25. Intellectual property
All website content, branding, logos, text, design, graphics, documents, resources, CPD materials, templates, videos, worksheets, software, platform design and other materials belong to TCN or its licensors unless otherwise stated.
You may not copy, reproduce, modify, sell, publish, distribute, licence or commercially exploit TCN content without written permission.
You may use content made available to you only in the way permitted by these Terms or by the relevant licence.
TCN’s name, logo and branding must not be used without permission.
—
26. User content
If you upload, submit or provide content to TCN, including profile text, photos, biographies, testimonials, comments, feedback or documents, you confirm that:
– You have the right to provide it
– It is accurate and lawful
– It does not infringe anyone else’s rights
– It does not breach confidentiality
– It does not contain unlawful or harmful material
You give TCN permission to use, display, reproduce and adapt your content as reasonably necessary to provide and promote the platform.
You remain responsible for your own content.
TCN may remove or edit user content where we consider it necessary.
—
27. Confidentiality
Users must respect confidentiality at all times.
Counsellors must not disclose identifiable client information through TCN community features, resources, forms, AI tools or support channels unless there is a lawful basis and it is appropriate to do so.
TCN will handle personal information in line with its Privacy Policy.
Confidentiality may be limited where there is risk of serious harm, safeguarding concern, legal obligation, regulatory requirement, fraud prevention need or another lawful reason to share information.
—
28. Data protection
TCN will process personal data in line with applicable data protection law, including UK GDPR and the Data Protection Act 2018.
Information about how we collect, use, store and share personal data is set out in our Privacy Policy.
Users must provide accurate information and must not submit another person’s personal data unless they have a lawful basis to do so.
Counsellors are responsible for their own data protection compliance in relation to their clients, clinical notes, client records, emails, assessment forms and therapeutic work.
Where TCN and a counsellor have separate data protection responsibilities, each party is responsible for complying with its own obligations.
—
29. Third-party services
TCN may use third-party services, including payment processors, booking tools, calendar integrations, email systems, hosting providers, analytics providers, video platforms, CPD platforms or AI systems.
TCN is not responsible for third-party services outside our reasonable control.
Third-party terms and privacy notices may apply.
We will take reasonable care when choosing third-party providers, but we do not guarantee uninterrupted access to third-party systems.
—
30. Website availability
TCN aims to keep the website and platform available, secure and functioning properly.
However, we do not guarantee that the website will always be available, uninterrupted, error-free or fully compatible with every device or browser.
We may suspend, withdraw, update or restrict access for maintenance, security, operational, legal or commercial reasons.
TCN is not liable for losses caused by website downtime except where liability cannot lawfully be excluded.
—
31. Changes to services
TCN may change, improve, remove, replace or update services, features, packages, prices, tools, resources, CPD access, booking functionality or payment functionality.
Where a change materially affects paid members, we will aim to give reasonable notice where practical.
TCN may withdraw a feature immediately where needed for safety, legal, ethical, technical or security reasons.
—
32. Suspension and termination
TCN may suspend or terminate a user account, counsellor profile, membership or access to services if:
– You breach these Terms
– You provide false or misleading information
– Payment fails
– You act unlawfully or unethically
– You misuse the platform
– You create risk for clients or members
– You breach confidentiality
– You breach safeguarding expectations
– You damage TCN’s reputation
– Your continued access may harm others
– TCN is required to do so by law or regulation
Where appropriate, TCN may give notice and an opportunity to respond. However, we may act immediately where necessary.
Termination does not remove any payment obligations already owed.
—
33. Complaints
If you have a complaint about TCN, you should contact us at info@thecounsellingnetwork.co.uk.
We will aim to respond fairly and within a reasonable timescale.
If your complaint is about a counsellor’s clinical practice, we may signpost you to the counsellor, their professional body, their employer, their insurer or another appropriate route.
TCN may review platform-related concerns but cannot replace professional body complaints processes, legal processes, safeguarding processes or regulatory processes.
Counsellors must cooperate reasonably with TCN where a complaint relates to platform use, profile accuracy, payment issues, bookings, conduct or safety concerns.
—
34. Disclaimers
TCN provides the platform on a reasonable care and skill basis.
However, TCN does not guarantee that:
– The platform will meet every user’s needs
– Counselling will produce a particular result
– A counsellor will be suitable for every client
– Resources will be suitable for every clinical situation
– CPD will meet every professional body requirement
– AI-supported tools will be accurate or appropriate
– Membership will generate referrals, income or business growth
Information on the website is provided for general information and professional support only. It should not be treated as medical, legal, financial, regulatory or emergency advice.
—
35. Limitation of liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any rights that cannot be excluded under consumer law.
Subject to the above, TCN is not liable for:
– Clinical decisions made by counsellors

– Loss of opportunity
– Reputational loss
– Indirect or consequential loss
– Third-party service failures
– User misuse of the platform
– Inaccurate information provided by users

– Events outside our reasonable control
For paid services, TCN’s total liability will usually be limited to the amount paid by the user to TCN for the relevant service in the 12 months before the issue arose, unless the law requires otherwise.

– Attempts to avoid agreed TCN platform fees
This does not apply where the loss is caused by TCN’s own negligence or breach of legal duty.
—
37. Events outside our control
TCN is not responsible for failure or delay caused by events outside our reasonable control, including:
– Internet outages
– Payment provider failures
– Hosting failures
– Cyber incidents

TCN is not responsible for the content, accuracy, privacy practices, terms, safety or availability of third-party websites.
You should review third-party terms and privacy policies before using them.
—
39. Advertising and promotional claims
Counsellors must ensure that any claims made on their TCN profile or through TCN are accurate, fair, ethical and not misleading.
Counsellors must not claim to treat, cure, diagnose or guarantee outcomes unless they are qualified, legally permitted and hold appropriate evidence for the claim.
TCN may remove promotional content that appears misleading, exaggerated, unsafe or inconsistent with professional standards.
—
40. Equality, diversity and inclusion
TCN expects all users, counsellors and members to act respectfully and without unlawful discrimination.
Users must not discriminate on the basis of protected characteristics, including age, disability, gender reassignment, marriage or civil partnership, pregnancy or maternity, race, religion or belief, sex or sexual orientation.
TCN may remove users or members who engage in discriminatory, abusive or harmful conduct.
—
41. Accessibility

If you experience difficulty accessing the website or require information in another format, please contact us at info@thecounsellingnetwork.co.uk.
We will consider reasonable requests and aim to improve accessibility over time.
—
42. Assignment
You may not transfer your account, membership, rights or obligations under these Terms to someone else without TCN’s written consent.
TCN may transfer its rights and obligations to another organisation as part of a restructure, merger, sale, transfer of business or platform development, provided this does not unfairly affect your rights.
—
43. Severance
If any part of these Terms is found to be unlawful, invalid or unenforceable, the remaining parts will continue to apply.
—
44. No waiver
If TCN does not immediately enforce a right under these Terms, this does not mean we have waived that right.
—
45. Changes to these Terms
TCN may update these Terms from time to time.
The updated version will be posted on the website with a new “last updated” date.
Where changes are significant and affect paid members, we will aim to give reasonable notice where practical.
By continuing to use TCN after changes are published, you agree to the updated Terms.
—
46. Governing law and jurisdiction
These Terms are governed by the laws of Scotland, unless mandatory consumer law gives you additional rights in another part of the UK.
If you are a consumer, you may have the right to bring proceedings in the courts of the part of the UK where you live.
If you are a business, counsellor, member or professional user, the Scottish courts will have jurisdiction unless TCN agrees otherwise in writing.
